If both parties can reach agreement on custody, there is free assistance available from the Office of Child Support in your county, working with the State's Attorney, who can help establish and collect child support. However the services of an attorney should be aquired to establish or modify child custody. Or, if you are facing divorce and cannot reach resolution by agreement on either custody or the related issue of child support and spousal support, it is important that you know all of your options and have a strong advocate representing your interests.
How is Custody Determined?
Custody decisions are based upon what is deemed to be in “the best interests of the child.” Some of the factors considered in the evaluation by the courts will include such factors as:
- Parental fitness
- Parental character and reputation
- The age/health/gender of the child
- The preference of the child, depending on age
- Desire of natural parents and agreement between them
- The desire of natural family relations
- Material opportunities affecting the future of the child
- The suitability of parental residence
- Effect of any prior abandonment or actions of a parent on the child
- The length of time since the child has lived with a parent
